Please read these Terms of Service ("Terms") carefully before using the Housing Grades platform ("Service"), operated by Housing Grades LLC ("Company," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.


1. Description of Service

Housing Grades provides subscription-based real estate market research and data analysis tools. The Service includes ZIP-code-level market scoring, metro-level investment rankings, rental yield estimates, and related data visualizations across approximately 80 metropolitan areas in the United States. The Service is updated on a monthly basis using publicly available data sources.

2. Not Investment Advice

THE SERVICE IS PROVIDED FOR INFORMATIONAL AND RESEARCH PURPOSES ONLY. NOTHING IN THE SERVICE CONSTITUTES FINANCIAL, INVESTMENT, LEGAL, TAX, OR REAL ESTATE ADVICE OF ANY KIND. Housing Grades LLC is not a registered investment adviser, broker-dealer, real estate broker, or financial planner. The scores, ratings, rankings, and analysis provided through the Service are quantitative research outputs based on historical and current public data. They do not constitute a recommendation to buy, sell, hold, or rent any property or real estate-related instrument.

You should consult a qualified financial advisor, real estate professional, or attorney before making any investment decision. Past signal performance does not guarantee future results. All real estate investment carries substantial risk, including the risk of total loss.

3. Eligibility

You must be at least 18 years of age and capable of forming a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements.

4. Account Registration and Security

To access the Service, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@housinggrades.com of any unauthorized use of your account. We are not liable for any loss resulting from unauthorized use of your account.

5. Subscription and Payment

The Service is offered on a monthly subscription basis at the pricing tiers published on our website. All fees are billed in advance on a monthly cycle. Fees are non-refundable except as expressly stated in these Terms or required by applicable law. We reserve the right to change pricing with 30 days' advance notice to subscribers. Continued use of the Service after a price change takes effect constitutes acceptance of the new pricing.

Payment processing is handled by Stripe, Inc. By providing payment information, you authorize us to charge your payment method for all fees incurred. You agree to Stripe's terms of service, available at stripe.com/legal.

6. Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to the Service through the end of the period for which you have paid. We do not provide prorated refunds for partial months.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
  • Reproduce, redistribute, sell, resell, or sublicense the data or content provided through the Service without our prior written consent
  • Scrape, crawl, or systematically extract data from the Service by automated means
  • Attempt to reverse engineer, decompile, or extract the underlying methodology or scoring model
  • Share your account credentials with any third party
  • Use the Service to create competing products or services
  • Interfere with or disrupt the integrity or performance of the Service

8. Intellectual Property

The Service, including all content, data outputs, scoring methodologies, visual interfaces, and software, is the property of Housing Grades LLC and is protected by copyright, trade secret, and other applicable intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to access and use the Service for your personal investment research purposes only. No other rights are granted.

The underlying public data used as inputs to our model (Redfin, HUD, FRED, Census, etc.) is subject to the terms and licenses of those respective providers.

9. Data Accuracy and Limitations

We make reasonable efforts to ensure the accuracy and timeliness of the data and analysis provided through the Service. However, we do not warrant that the Service is error-free, complete, or current at all times. Data from third-party sources may contain errors, omissions, or delays. Rental yield estimates are gross figures based on HUD Fair Market Rent data and do not account for vacancy, maintenance, property taxes, insurance, or financing costs. Market scores and conviction tiers are quantitative outputs of a rules-based model and involve inherent limitations and assumptions.

YOU ACKNOWLEDGE THAT THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOUSING GRADES LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO US IN THE THREE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Housing Grades LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify subscribers of material changes by email or by posting a notice on the Service. Your continued use of the Service after the effective date of any modification constitutes your acceptance of the revised Terms.

13. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause, with or without notice. Upon termination for cause (including violation of these Terms), no refund will be issued. Upon termination without cause, we will provide a prorated refund for the unused portion of your current billing period.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place in Los Angeles County, California. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

15. Miscellaneous

These Terms constitute the entire agreement between you and Housing Grades LLC with respect to the Service and supersede all prior agreements. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
